Applicants With Criminal Convictions

How To Become a Licensed Massage Therapist/ Schooling, Licensure and Continuing Education

If you have ever been convicted of a felony or misdemeanor or pleaded guilty or no-contest to any in-state, out-of-state or federal criminal offense, you must provide a completed Criminal History Questionnaire along with your application materials.

Criminal convictions are reviewed on a case-by-case basis. Licenses may be denied based on the nature of the conviction and how long prior to the application the conviction occurred. Depending on your criminal history, a review can take from one to six weeks to complete.

Individuals may request TDLR review their criminal background before actually applying for a license. TDLR uses the same process for this pre-application evaluation as the process described below. See the Criminal History Evaluation Letter page for more information.

Please see the Guidelines for License Applicants with Criminal Convictions, which describe the process that TDLR uses to determine whether a criminal conviction renders an applicant an unsuitable candidate for the license, or whether a conviction warrants revocation or suspension of a license previously granted.

Should You Make Conversation During The Massage

The only things you need to tell your bodyworker are:

  • If their technique is hurting you.
  • If you have any medical conditions or old injuries that give you chronic pain.
  • If you need them to spend more time on any extra sore muscles.

Any conversation beyond that is entirely optional and up to you. Do whatever helps you relax and feel comfortable.

Understanding Federal And State Massage Therapy License Laws

Regulations about massage therapy certification and licensure are often misunderstood.

Massage therapists aren’t subject to any national regulations when it comes to running this type of business. There isn’t a national licensing or certification program that would allow a single massage therapist to practice anywhere within the United States.

Many states have a massage therapy board that sets educational requirements, testing requirements, and issues licenses. So, it’s important to understand and follow the regulations that apply to massage therapists in the state or states where the therapist practices.

Do You Require A Health Questionnaire From Your Clients

Devon Lockwood Providing Geopathic Stress Removal, Massage Therapy and Yoga

In many states, the law requires therapists to ask clients to fill out a health questionnaire at the same time they also sign a waiver confirming that they understand the terms and conditions of the massage service. If you aren’t asked for any of this, then you should question if they are a licensed therapist.

    Licensing Certification And Registration

States differ in the way they regulate their massage professionals. This could mean requiring a different type of credential, such as a license vs. a certification or registration. Licensing tends to be the most rigorous form of regulation, and almost every state now uses licensing.

The only states that do not currently require statewide regulation are Kansas, Minnesota, Vermont and Wyoming. However massage therapists who practice in these states will still have to comply with any local licensing laws and regulations.

The length of time that it takes to process a license application varies. It all depends on how much information the board has to collect and review, and how efficient and timely their data collection and review processes are. A common source of delay is an application that has not been completed correctly.

    Applicants Licensed In Another Jurisdiction

If you are licensed in another state, country or territory based on specific education and examination requirements, and have practiced massage therapy in that state, country or territory for at least two years, you may be eligible for licensure by endorsement.

  • You may be eligible for licensure by endorsement if you:

  • Have been determined by the Department to be of good moral character
  • Are in good standing as a licensee in each state, country or territory in which you are licensed to practice massage therapy
  • Received a certificate for completing a course in Cardiopulmonary Resuscitation within the three years prior to New York State licensure
  • In addition to meeting the requirements of Section A, you must satisfy the following requirements:

If you have been licensed and practiced 2 – 4 years in another state, country or territory, you must:

  • Meet the New York State 1,000-hour education requirement for licensure
  • *One year of experience is defined as 52 weeks in which massage therapy is practiced an average of 12 hours each week.

If it does, ask if massage is covered as a medical necessity. If so, you can submit the massage prescription from your licensed medical professional and apply for reimbursement from the money you set aside. This guideline covers a variety of areas including what to expect from an assessement, what to wear to your massage therapy appointment, what self-care recommendations you can antitcipate and the importance of informed consent. This guideline was designed to help patients of massage therapists feel more confident in accessing massage therapy care by knowing what to expect.

Massage Therapy : How Long Does it Take to Be a Massage Therapist?

In many areas of the country, small business owners must carry a certain amount of insurance.

The AMTA recommends that massage therapists carry massage liability insurance to protect their business from malpractice lawsuits. Students should also consider getting general liability insurance for school-sponsored and career-related educational activities. Massage therapist insurance is widely available, but it’s important to understand local regulations as well as the needs of the business before purchasing a policy.

What If You Get An Erection During A Massage

To most bodyworkers, a client who gets an erection is not a big deal. They view the client through the eyes of their training, as if seeing a collection of organs and muscles on the table through an X-ray machine. Therefore, a licensed massage therapist or esthetician will ignore an erection and let it go away on its own. Their policy is not to come into any contact with genitals or nipples, and the law requires them not to cater to any clients requesting sexual contact either.

    Consider Opening Your Own Practice

Once youâre ready to start working, the first major fork in your career path will be whether to work with a larger, more established practice or branch out on your own. Both options have their pros and cons. Starting with an established clinic means youâll have a steady stream of clients, a steady income, and health insurance and other benefits. Especially if youâre just starting, it can be comforting to work under a more experienced therapist who can give you on-the-job tips to help you with the rest of your career.

However, in starting your own practice, you can be your own boss, setting your schedule, rates, and services. You can work out of your own home and build the career of your dreams. It may be a bit harder starting out, but you can say that youâve truly created something of your own.
